Introduction
Flitsmeister attaches great importance to respecting your privacy. Your personal data is therefore handled very carefully and is properly secured. Flitsmeister abides by European and Dutch privacy legislation. In this privacy statement, we provide more information about how we handle your personal data.
Who is Flitsmeister?
Flitsmeister is a trade name of Flitsmeister B.V. We are located at Landjuweel 24 in Veenendaal and are registered in the trade register of the Chamber of Commerce under number 55408567.
Flitsmeister and Truckmeister are the most complete traffic information apps for consumers and lorry drivers, respectively. These apps are available for iOS and Android and are provided free of charge. It is also possible to create an account on a subscription basis, in which case the apps will offer extra features. When we refer to the "app" below, we mean the Flitsmeister and Truckmeister apps. There are also additional services, which are explained at additional services.
What data does Flitsmeister process and what is it used for?
Data of users who do and who do not have an account
As a standard, Flitsmeister processes the following data.
On the website:
Technical data. This concerns data such as one or more unique numbers that refer to the device you are using.
Cookies. We tell you more about the use of cookies in our cookie statement.
In the online shop:
Contact details: e-mail address, address and place of residence,
Payment details: Information about invoices and payments including the payment history.
The reason we ask for this information is very practical: after all, we will have to deliver the products. Your address details are shared with a delivery service so that they can carry out the delivery. Your data will then be included in our administration.
For all app users:
Technical information about your phone. These details include one or more unique numbers that connect to your phone.
Your location data. This is data about your exact location, direction and speed and the time of the measurement.
Data of users who have an account
Flitsmeister additionally processes the following data from users who have an account:
Contact details. These are your email address and password, and any contact details you yourself put in the account (such as gender, age, photo).
Usage data. This is data about your historical trips, about your use of our additional services and any settings and preferences set in the app.
If you log in via Apple, Google or Bip&Drive, these services will transfer certain data to us. We do not store all these details; we only store your first name, surname, age bracket and gender. In the case of Bip&Drive, we also record information about whether the payment obligation for the subscription has been fulfilled.

What legitimate interest does Flitsmeister have?
For the processing of personal data that does go beyond what is strictly necessary for the provision of our services, which is not based on a statutory duty, nor on your consent, Flitsmeister relies on what is called a "legitimate interest". That legitimate interest lies in everything that is necessary for the normal management and continuity of our business operations, in our interest to ensure the security and reliability of our products and services, as well as in our interest to be able to improve our products and services and develop new ones. Of course, in doing so, we take your privacy into account (as explained in this document). If you feel that we are violating your privacy, you are free to file a complaint (see below in this privacy statement).
Provision of data to third parties
The basic principle is that we will never provide your data to third parties, unless you give your consent to that provision or we are legally obliged to do so. However, we do provide aggregated/group-level data to third parties. This is data that is no longer traceable to an individual phone/person. We may, for example, relay congestion information or statistical information about the amount of traffic on certain roads.
Certain additional services may require your data to be shared with third parties. In the case of additional third-party services, you either enter into an agreement with that third party or you give prior consent for Flitsmeister to share your data with that third party. The terms and conditions and the privacy statement of that third party will then apply. We will make you aware of this before you purchase the service or before you consent to sharing your data with that third party. We encourage you to read that third party's privacy statement and terms of use thoroughly before entering into the agreement or giving your consent.
Provision to road authorities
With your consent, we may send your data to road authorities (including Rijkswaterstaat in the Netherlands or Agentschap Wegen en Verkeer in Flanders). This only involves data that we cannot trace to a user, such as location data linked only to a unique session number. As we cannot completely rule out the possibility of a road authority being able to trace this data to a user, we will ask for your consent (on behalf of that road authority). It will use this information for its services (for example, optimising traffic flows, the better adjustment of traffic lights, warnings about the arrival of emergency services).
Provision for statistical purposes
With your consent, we may pass your data on to third parties to generate statistics about the use of our app. We use two external services for this: Google Analytics and Insider. Both companies track app usage in various ways, including through cookies. To the extent that these are not functional cookies, we ask for your consent to this tracking and the technologies used for them when you first use our website.
Google Analytics is a Google service (www.google.com). Google processes the data that Flitsmeister collects by means of Analytics. For more information on how Google handles that personal data, please refer to Google's general privacy policy, which you can read here: http://www.google.com/privacy.html. Flitsmeister has set up Google Analytics in accordance with the "Guide to setting up Google Analytics in a privacy-friendly way" (version of August 2018) issued by the Dutch Data Protection Authority.

Disclosure without prior consent
We provide technical data to Google so that we can verify that the app you have on your phone is really our app. This helps us prevent unauthorised redistribution and piracy. You can read more about this in Google's explanation: https://support.google.com/googleplay/android-developer/answer/10183279.
Furthermore, we use an external delivery service for any orders you place with us. Your address details will therefore be passed on to that party when you place an order.
International transfer
Your data will only be processed within the EU. Your data will not be processed in countries outside the EU. To the extent that personal data is in fact transferred to countries outside the EEA (third countries), we take measures to ensure an adequate level of protection. Where possible, we also base these transfers to third countries on an adequacy decision adopted by the European Commission. If the European Commission has not adopted an adequacy decision for a third country, we provide appropriate safeguards by basing the transfer on and complying with standard contractual clauses adopted by the European Commission.
Automated individual decision-making and profiling
Flitsmeister does not use automated individual decision-making and profiling technologies.
As part of its services, Flitsmeister may use AI applications to perform various administrative tasks. Under no circumstances will this lead to automated individual decision-making without you having given your consent to this.
Retention period
Flitsmeister does not retain personal data longer than necessary. Personal data will be retained for a maximum period of 6 months after the last use. For third-party retention periods, please consult their privacy statements.
Security
Flitsmeister will implement appropriate technical and organisational measures to secure your personal data against loss or against any form of unlawful processing.
Your rights
By law, you have the following rights:
Right of access. You have the right to know what personal data Flitsmeister processes about you.
Right to rectification. You can ask us to correct, supplement, delete or restrict your data if you believe this data is incorrect or the processing is irrelevant or is in violation of the law.
Right to data portability. You have the right to receive from us location data processed by us and any other data we process about you based on consent in a digital file format.
Right to object. You may object to all processing not based on consent and which goes beyond what is necessary for the fulfilment of statutory obligations or the performance of the agreement.
You may also withdraw your consent to the data processing operations if they were based on your consent. This does not affect the data we have already stored; the withdrawal of consent only applies to future processing.
Data protection officer
Flitsmeister has appointed a data protection officer (DPO). The DPO monitors compliance with the privacy legislation and advises Flitsmeister on privacy legislation.
The DPO is independent and enjoys legal protection from dismissal. The DPO reports directly to Flitsmeister's most senior executive. Moreover, the DPO is the contact person for all privacy-related questions, both for you as a data subject and for the supervisory authority.

Statistical information using third party services
Google Analytics is a service offered by Google (www.google.com). Google processes the data that Flitsmeister collects by means of Analytics. Flitsmeister has set up Google Analytics in accordance with the Instructions on setting Google Analytics in a privacy-friendly manner (“Handleiding privacyvriendelijk instellen van Google Analytics”, version of August 2018) issued by the Dutch Data Protection Authority.
Insider
Insider is a marketing platform. Insider processes the data that Flitsmeister collects. For more information on how Insider handles that personal data, please refer to Insider's privacy policy, which you can read here: https://useinsider.com/privacy-policy.
Supervisory authority
Compliance with the privacy legislation is monitored by a national supervisory authority. You have the right to lodge a complaint with the supervisory authority. You may also contact the supervisory authority with questions about privacy legislation. The overview below lists the national supervisory authorities for a number of countries. In addition, you may always contact the 'lead supervisory authority'. For Flitsmeister, this is the Dutch supervisory authority.

Please note that if you are under 16 and located in the Netherlands, this request must be submitted by your legal representatives (your parents or your guardian). This age limit may vary from country to country. In Belgium, for example, an age limit of 13 applies.

This privacy statement is subject to change. These changes will be announced on our website.
Flitsmeister may process your data for new purposes not yet mentioned in this privacy statement. In that case, we will contact you before using your data for these new purposes, to inform you of the changes to our privacy statement and to give you the opportunity to opt out.
Additional services
If you use additional services (i.e. other than the website, app or online shop), additional data may also be processed. We set out what this means in what follows.
Business accounts
A business account allows your employer or client to pay for your account. As a self-employed person, a business account allows you to separate your private trips from your business trips.
In general, the app works exactly the same as it does with a private account. The way we handle your personal data is also largely the same. What is different, however, is the transfer of some of your personal data to the business account.
As the owner of the business account needs this data to verify the accuracy and to make payments, among other things, we pass on your account details, your vehicle registration details and information on any fees due. This is, of course, limited to what is absolutely necessary. When establishing a link with a business account, we always ask for your consent to pass on the data to the owner of the business account.
Fleet Platform
The Fleet Platform is an additional service involving the provision of data to third parties. As the Fleet Platform is slightly different from the standard additional services, we will provide an explanation.
The Fleet Platform is designed for companies that use drivers, such as lorry drivers, delivery drivers and employees. These companies may be the driver's employer or they may be other companies (such as the party instructing the trip).
Through the Fleet Platform, the company can share a code with the driver. Acceptance of the code makes a link to the company's system and allows the company to track where the driver is driving.
The driver has and maintains control over their own personal data. It is only after the driver gives consent by accepting the code that data is shared with the company. The driver may then withdraw their consent at any time.
If you use the Fleet Platform, we also process your identity details. These are your name, date of birth and place of birth. Through the Fleet Platform, the driver also shares a limited set of data with the company. This only covers the driver's name, location data, vehicle details and arrival times. So - apart from the name - no driver account details are shared with the company.
A scan of the driver's ID may also be requested for specific trips. The driver then takes a scan (photo) of their identity document. The driver's name, place of birth and date of birth are read from the scan and stored. The scan is temporarily stored locally on the phone during the data readout. Other data will be deleted immediately after the scan. Flitsmeister does not have access to the temporary storage of the scan. After the driver has given their consent, the driver's name, place of birth and date of birth are shared with the company in the context of the specific trip.
If you use the Fleet Platform, we will additionally process your data for the following purposes:
To share data with an authorised other user (for example, to make a link to an employer's or client's system);
To trigger actions set by you based on location data;
To display Points of Interest and offer priority arrangements;
To link scanned data to a specific trip.
Both the company and the driver may request a 24-hour real-time overview and analyses of the last two months. Furthermore, the company may set certain actions to be triggered when a driver approaches a 'Point of Interest' set by the company, such as an intersection or traffic lights. This could include giving way or priority to the driver or automatically reporting the presence of the driver in question. Once the signal is set off, location and vehicle data is sent.
Finally, no departure buffer is applied when a driver starts a trip.
Trip History
Trip History is an additional service that works slightly differently from the standard services. The trips you make are tracked and recorded. You can then view an automatically generated overview of your trips.
When you use the app, some of your details are recorded and further used, specifically vehicle data and trip data. Vehicle data is data such as registration number, the make of the car and mileage when manually entered into the app. Trip data includes start and end timestamps, speed and number of kilometres driven. The purpose of recording trip data is to give you an overview of your trips with their distances and destinations. The entire trip, from the point of departure to the destination, is recorded. This means that, in contrast with the normal use of the Flitsmeister app, no 'departure buffer' is applied that removes the location data of the departure and arrival points.
When you use Trip History, personal data is not automatically deleted after six months. Your data is stored for as long as you use Trip History in order to avoid the loss of your trip data. When you cancel your Trip History subscription, your data will be deleted two months after the cancellation date. In any event, Flitsmeister will not keep personal data for longer than is necessary.
Additional information
How do we use your location data?
If you have given your consent to this, location data will be processed and stored when you use the app. In that case, the route travelled, date/time and speed of each trip will be recorded. This is done anonymously, as further explained below.
By storing the data from individual trips separately, we can provide you with interesting (statistical) data about your driving behaviour. This method of storage is also necessary for us to verify reports of, for example, speed cameras. It is also necessary for us to store the data in this way to generate the (statistical) information described above (such as traffic information).
The data we collect is anonymised. Broadly speaking, we have taken the following measures for this:
Ample departure buffer: we only start measuring after you have driven at least 500 metres. Moreover, exactly when the meter starts running differs from trip to trip. This makes you blend, so to speak, into the large mass of other Flitsmeister users driving near you. As a result, we cannot afterwards trace exactly where you came from using the location data.
Unique session number: each trip is given a unique number, which is always different. There is no connection between those numbers. We do not know which person has which number.
Limited storage: after six months, we delete the anonymous data.
If you have an account, you can choose to link trip data to that account via an opt-in. Once you do so, the data is - therefore - no longer anonymous. Statistics such as travel time and top speed are automatically linked to the account. The user can reset these at any time.
When you use Trip History, your entire trip is recorded. In that case, your location data is stored in a separate database.
What is ETA sharing?
ETA (Estimated Time of Arrival) sharing involves sharing your estimated time of arrival. If you have ETA sharing enabled, real-time location data is sent to Flitsmeister during your trip. Every time Flitsmeister receives new location data, the old location data is deleted. This means we do not keep a history of your locations. The most recent location is kept in the system for 8 hours. This data is not linked to your identity.
What is a profile score?
Flitsmeister assesses notifications that users send via the app about, for example, speed cameras or congestion. Flitsmeister does this using a computational model, on the basis of which useful notifications are displayed in the app and incorrect ones are removed. This allows Flitsmeister to ensure the quality of the app.
When a user sends multiple useful notifications, the user's profile score goes up. Conversely, the same applies. If a user is found to be sending incorrect reports, their profile score goes down. The profile score is based on the accuracy of reports over the last three months. Users cannot see each other's profile score. This is only seen by Flitsmeister and is not shared with third parties. If you do not want Flitsmeister to keep your profile score, you may object to this.
